User Agreement
This document will outline the Terms and Conditions for Users of www.dancewearexchange.com.au (Dancewear Exchange, part of Visual Volcano Pty Ltd Australia).
1. Fees and Services
1.1 Services
The use of Dancewear Exchange implies the Users acceptance of all Terms & Conditions. Dancewear Exchange is an interactive On-line Auction Venue. We are not Auctioneers rather, we publish items submitted by "Users". Dancewear Exchange is not involved in the actual transaction between Buyers and Sellers. We obviously have no control of the safety, quality or legality of the items advertised. We assume that the Users list the items in good faith and accuracy.
Dancewear Exchange are not responsible that a Buyer and Seller will actually complete the transaction. Dancewear Exchange do not own the items listed, therefore we cannot transfer ownership from the Seller to the Buyer. The User, after registration will be able to use the services of Dancewear Exchange. Dancewear Exchange shall have the discretion to register or deny access to Dancewear Exchange Users at any time.
Dancewear Exchange reserves the right to modify or discontinue any feature of the Dancewear Exchange including but not limited to content, systems and hours of availability at any time without the need for prior notice. In no event is Dancewear Exchange liable for any loss or damage including indirect or consequential loss or damage.
1.2 Fees
At Dancewear Exchange we endeavour to give you absolute value for money, therefore we have an affordable listing fee. We also have what we call a success fee; which is payable only if and when your item sells giving you a risk free way to sell your goods. To view complete FEES list, click here.
The listing fee charged is dependent on the final sale price of your goods.There are also a number of options you may choose to maximize your listings. Listing (posting) fees are charged during the listing process. Success fees are charged on the first of each month for the previous months activities. At the beginning of the month you will receive an invoice outlining the fees which you owe. You will then have 7 (seven) days to make the payment via the site with either credit card or PayPal. If your account is not settled within 7 days your access to the site may be restricted.
Bidding is free on Dancewear Exchange however you must register and accept the fees you may be charged before you are able to list an item on Dancewear Exchange.
We reserve the right to change the fees without any prior notice to the User.
Unless otherwise stated all fees will be in $AUD. You are responsible for all fees associated with using the services of Dancewear Exchange.
2. Bidding and Buying
The User agrees to comply with all the terms and conditions hereof. The right to Use Dancewear Exchange is agreeable by the User and not transferable.
Registration and Bidding is free on Dancewear Exchange however you must register before you are able to Bid on or Sell items.
As a Seller you are obliged to sell the item to the winning Bidder for the price as stated at the end of the Auction.
As a Buyer, you are committed to buy the item from the Seller at the price stated at the end of the Auction (if you are the winning Bidder).
Whilst it is the Seller that should not offer broken or faulty goods for sale, Dancewear Exchange will monitor the listings to decrease the chance of any such products being listed. Consumers also need to be careful when purchasing secondhand products.
To increase the price that your pre-loved goods could sell for, always where possible include any original packaging, tags, instructions, warranties or warnings.
3. Confidentiality
The User is responsible for the confidentiality of his or her User names and Passwords.
The User is responsible for any activity in their account. Any suspected fraudulent activity must be reported immediately to info@dancewearexchange.com.au
4. Privacy Policy Statement

At no time will your information be shared or sold. For each visitor our web server automatically recognises information regarding the ip address for security purposes.
We collect information volunteered by the consumer, such as survey information and/or site regulations.
If you do not wish to receive email from us in the future, please let us know by sending us an email at admin@dancewearexchange.com.au
If you supply us with your postal address on-line you may receive periodic mailings from us with information on new products or services or upcoming events. If you do not wish to receive such mailings, please let us know by sending an email to: admin@dancewearexchange.com.au
Please provide us with your exact name and address. We will make sure that it is removed from our list.
Persons who supply us with their telephone number on-line may receive telephone contact from us with information regarding new products, services or upcoming events.
If you do not wish to receive such telephone calls, please let us know by sending an email to: admin@dancewearexchange.com.au
asking to be removed from our telemarketing list. From time to time we may use customer information for new unanticipated uses not previously disclosed in our Privacy Policy. If our information practices change at any time in the future we will post the Policy changes to our website to notify you of these changes and provide you with the ability to opt out of these new uses.
If you are concerned with how your information is used, you should check back at our website periodically. Upon request we provide site Users with access to their contact information (e.g., name, address, phone number)

5. Intellectual Property
All intellectual Property including Trademarks, Logos and Domains are the exclusive rights to Dancewear Exchange. The User does not acquire the right to reproduce, distribute or transform any of the intellectual Property. All Rights Reserved.
6. Permitted Uses
The User shall use the site for Lawful purposes only. Users shall not post any items or material which infringes in any way on the rights of others. Users shall not use the site in ways which is invasive of Privacy laws. Therefore the User agrees not to breach any rules of use of the internet or laws applicable to the country the User resides.
The User does not have the right to use Dancewear Exchange content without the prior written authorisation of Dancewear Exchange.
The User does not have the right to limit or constrain any other User from using Dancewear Exchange.
Users shall not use Dancewear Exchange to advertise any commercial solicitation including but not limited to, the solicitation of Users to become subscribers of other on-line informational services competitive with Dancewear Exchange.
Users shall not upload or post any material protected by copyright or trademark without the permission of the owner of the copyright.
Any material submitted to Dancewear Exchange by the User automatically grants Dancewear Exchange the non exclusive rights to use and publish the image and information.
The User also permits other Users to access, view, store or reproduce the material for the Users personal use.
7. Disclaimer
The User agrees that the Use of Dancewear Exchange is entirely at the Users sole risk. Neither Dancewear Exchange, its affiliates nor any of their respective employees, agents, 3rd party providers warrant that Dancewear Exchange will be uninterrupted or free of errors. Although every precaution will be taken to avoid such action.
Dancewear Exchange do not make claims to the success, reliability or content of any listing. No guarantees are made to the outcome of each listing, nor are there any warranties on any product sold via Dancewear Exchange. Dancewear Exchange do not own any of the products. It is a separate transaction between the Buyer and the Seller (Users).
8. Monitoring
Dancewear Exchange have the right, but not the obligation to monitor the content on Dancewear Exchange to determine suitability, satisfy laws and terms and conditions. Dancewear Exchange have the right to edit, refuse or remove any material posted.
9. Termination
Dancewear Exchange may terminate this agreement at any time or a Users account in the event of misconduct, unacceptable behaviour or any breach or any agreement.
10. Refund Policy
Dancewear Exchange does not offer any refund on Membership Fees. If monthly Fees are introduced they will not accumulate and will not be refunded. Dancewear Exchange does not offer any refunds for listing or success fees. No guarantees are made to the outcome or success of each listing.
There are no warranties given by Dancewear Exchange to any product which is sold via the website. However, there may be a warranty or returns policy offered by the Seller of the goods. Please refer to each individual listing.
The User is responsible for his or her User name and Passwords. If fraudulent activity is suspected within your account, it must be reported immediately to admin@dancewearexchange.com.au
In the case where the activity is proven to be fraudulent and unauthorised amounts have been charged to your account, a refund or credit will be issued totaling that amount.
In the unlikely case of the above, the method of refund will be via the payment method you currently have on file. Before such time, please verify that all your contact information is correct by clicking on "My Account". Please allow 30 days for processing.
11. Competitions
From time to time Dancewear Exchange will run promotions, competitions and incentives. The User agrees that should they win any such prize, they consent that their name to be published on the website as the winner of any such prize.
12. Storefront
It is compulsory for Business listings to have a Storefront.
